About Mornington's Biggest Ever Easter Egg Hunt

Mornington's Biggest Easter Egg Hunt is an annual community event run by Stone Real Estate Mornington Peninsula. The event will begin at 10am and involves a variety of children's age groups participating in the Easter Egg Hunt across the park. The day's festivities will also include children's entertainment, musicians, food trucks and activities the whole family can enjoy. This will be a family fun day, we encourage families to bring along picnic rugs and enjoy the food and activities the day will provide. As this is a local event, we believe it is important to support local charities, so this year we are asking for a gold coin donation from every attendee to go towards Fusion Mornington Peninsula - Fusion provide assistance to young homeless people in the area. This event will be a great way to spread the word about the amazing work Fusion do, as well as provide a family fun filled day.

Please note the Hunt caters for ages 0-12 years; you will be notified via email as to what time your Egg Hunt will take place.

ASSUMPTION OF RISK, WAIVER OF LIABILITY, AND INDEMNITY AGREEMENT

Participants: Read this document carefully before accepting. This document has legal consequences and will affect your legal rights and may eliminate your ability to bring future legal actions.

Released Parties Include: Mornington Real Estate Pty Ltd T/A Harcourts Mornington (ABN 77 162 113 420) and its affiliates and their respective directors, officers, employees, agents, contractors, insurers, spectators equipment suppliers and volunteers; venue and organisers, promoters, directors, property owners, and advertisers’ governmental bodies and/or municipal agencies whose property and/or personnel are used; and any or all parent, subsidiary or affiliate companies, licensees, officers, directors, partners, board members, supervisors, insurers, agents, equipment suppliers, and representatives of any of the foregoing including but not limited to Mornington Real Estate Pty Ltd T/A Harcourts Mornington.

Releasing Parties include: The participant as well as participant’s spouse, children, parents, guardians, heirs, next of kin, and any legal or personal representatives, executors, administrators, successors and assigns, or anyone else who might claim or sue on participant’s behalf.

WARNING OF ASSUMPTION OF INHERENT RISKS

Mornington Largest Easter Egg Hunt Event (herein referred to after as the HUNT event) is a hazardous activity that carries with it inherent risks of physical injury. Inherent risks are risks that cannot be eliminated completely regardless of the care and precautions taken by Mornington Real Estate Pty Ltd and other released parties. I understand and acknowledge that the inherent risks include but are not limited to 1) contact or collision with persons or objects, contact with other participants, contact with man-made objects or obstacles 2) encounter with obstacles 3) equipment related hazards 4) imperfect event conditions including weather conditions which increase the risk of slipping or falling 4) weather related hazards 5) inadequate first-aid and/or emergency measures 6) judgement and/or behaviour-related problems by other participants.

WAIVER OF LIABILITY for Ordinary Negligence

I acknowledge that, notwithstanding anything to the contrary contained within this agreement, this Agreement will not be read or applied so as to purport to exclude, restrict or modify or have the effect of excluding, restricting or modifying the application in relation to the supply of any services pursuant to this Agreement. I agree that under this agreement Mornington Real Estate Pty Ltd and other Released Parties shall be excluded from;

Liability for death, physical or mental injury (including the aggravation, acceleration or occurrence of such injury) the contraction, aggravation or acceleration of a disease or the coming into existence, the aggravation, acceleration or occurrence of any other condition, circumstance, activity, form of behaviour, course of conduct or state of affairs in relation to an individual that is or may be harmful or disadvantageous to me or the community or that may result in any harm or disadvantage to me or the community which arises out of my participation in the Hunt event including liability which arises.

INDEMNIFICATION AGREEMENT To the extent permitted by law, I/we hereby agree to hold harmless, defence and indemnify (for which avoidance of doubt includes defending and paying any judgement, court costs, investigation costs, attorney fees and any other expenses incurred that relate to a breach of this contract) Mornington Real Estate (any other released parties) from any and all claims made by me (or any releasing party) arising from the death, physical injury or mental injury (including the aggravation, acceleration or occurrence of such an injury), the contraction, aggravation or acceleration of a diseased or the coming into existence, the aggravation or occurrence of any other condition, circumstance, occurrence of activity, form of behaviour, course of conduct or state of affairs in relation to an individual that is or may be harmful or disadvantageous to me or the community.

I/we further agree to hold harmless, defend, and indemnify (which for the avoidance of doubt includes defending and paying any judgement, court costs, investigation costs, attorney fees and any other expenses incurred that relate to a breach of this contract) Mornington Real Estate Pty Ltd (and other released parties) against any and all claims of co-participants, rescuers, and others arising from my conduct in course of my participation in the Hunt event.

Acknowledgment of Understanding I/we have read this Assumption of Risk, Waiver of Liability & Indemnification Agreement and full understand its terms. I/we understand that I/we am giving up substantial rights, including my right to sue. I further acknowledge that I am accepting the agreement freely and voluntarily, and intend my acceptance to be a complete and unconditional release of all liability due to Ordinary Negligence of Mornington Real Estate Pty Lts (and other released parties) or the Inherent Risks of the activity to the greatest extent allowed by the laws in force of the Commonwealth of Australia or of any State or Territory of the Commonwealth of Australia in which the Hunt event is held.

I agree to become familiar with and abide by all written and/or posted rules of the Hunt Event (Mornington Real Estate Pty Ltd) as set out in the Participant Course Rules below:
- Upon arrival all children must register their attendance and receive a coloured band
- All children will be provided with a hunting basket at the registration table
- Parents who have children under 3 will be allowed to enter the hunt with their children.  
- All collected eggs in the hunt must only be put in the baskets (none are to be hidden in pockets)
- We have allocated a certain number of eggs per child. Any parent to be seen hiding eggs or grabbing eggs for their children in between hunt times will be asked to leave
- Any children who enter the hunt before their advised start time in between event times will be asked to leave & put back eggs  
- Any lost children will be taken to the information tent
- Ambulance Victoria will be there in case of any injuries  
- Please ensure all care is taken to remove and take away any of your rubbish throughout the day
- Once your allocated event time has finished. Please leave the hunting area promptly in order for our runners to setup for the next start time
- Any parents seen to be disadvantaging other children will be asked to leave

I/we understand that Mornington Real Estate and venue personnel may immediately cause anyone who disobeys any rules, directions, instructions, decisions or whose behaviour endangers safety or negatively affects another person can asked to be removed immediately.

I/we agree to exhibit appropriate behaviour at all times, demonstrate respect for people, equipment, facilities and participate with a cooperative and positive attitude.

I/we certify that I am not and on the date of the Hunt Event will not be under the influence of drugs or alcohol. I further understand that alcohol consumption following the event is discouraged by Mornington Real Estate Pty Ltd. 

DECLARATION

1. I/We understand that participating in the Hunt Event is physically challenging and poses potential risks of serious injury and/or death.


2. I/We assert that I am in good health and in proper physical condition to safely participate and I have a parent/guardian who will supervise me.


3. I/we understand that as the parent/guardian of your registered child, you are personally giving the chocolate easter egg to your registered child. Mornington Real Estate Pty Ltd intends to give the parents full responsibility of providing Cadbury easter eggs to their registered child and will not be held responsible or liable for any registered children eating chocolate.

By ticking the box  I/We affirm that I am eighteen (18) years of age or older and have read this entire document and understand its contents. Further, I/we warrant and represent that I have the legal capacity and authority to act for and on behalf of the minor named herein, and I agree to indemnify and hold harmless the persons or entities mentioned in this document for any claims made or liabilities assessed against them as a result of any insufficiency of my legal capacity or authority to act for and on behalf of the minor in the execution of this document.
